RESPONSIBILITY

National Geographic Unique Lodges of the World is a collection of select lodges and hotels that provide enriching travel opportunities as outlined on nationalgeographiclodges.com.  National Geographic Partners, LLC, and its designated reservation agent act only as an agent for any transportation carrier, member lodge or hotel, ground operator, or other suppliers of services (“Other Providers”), engaged by an individual, and the others in their party, making a reservation to stay at a lodge (individually and collectively referred to as “Guests”) and the Other Providers are solely responsible and liable for providing their respective services.  For any transportation services, the passenger tickets in use by the carriers shall constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time Guests are not aboard their conveyances.

National Geographic Partners, LLC , its parents, subsidiaries, affiliates, and their respective employees, officers, directors, successors, representatives, assigns (collectively “National Geographic”) and its designated reservations agent shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider;  (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control, or (C) any air carrier's cancellation penalty incurred by the purchase of a nonrefundable ticket in association with the lodge reservation. Baggage and personal effects are at all times the sole responsibility of the Guest. The Guest waives any claim against National Geographic and/or its designated reservations agent for any such loss, damage, injury, or death and agrees that the release of liability that will be binding upon his or her family, heirs, and legal representatives.

By making a reservation to stay at a lodge, the Guest certifies that he or she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or others. National Geographic and its member lodges reserve the right in their sole discretion to accept, decline to accept, or remove any Guest from a lodge.

TERMS AND CONDITIONS

Basis of Rates: All prices and fares are quoted in U.S. dollars. The rates are based on tariffs, currency values, airfares and third-party charges and are subject to change due to significant changes in exchange rates or other unforeseen circumstances. While National Geographic will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge, National Geographic reserves the right to do so, and notification will be given at the time of final invoicing.

Eligibility: Anyone under 18 must be accompanied by a parent or guardian for the entire journey.  Many lodges have specific policies and pricing with respect children accompanying adults; please review the details related to specific lodges on the National Geographic Unique Lodges of the World website (www.nationalgeographiclodges.com).

Included in Lodge Cost: Accommodations and one National Geographic Exclusive experience per lodge as described on the National Geographic Unique Lodges of the World website (www.nationalgeographiclodges.com); meals, activities, excursions, and local taxes/fees are included only if specifically noted on the website.

Exclusions: Air transportation and related fees; any meals, activities, excursions, transfers to and from the lodge, local taxes/fees, and gratuities not specifically listed as included on the National Geographic Unique Lodges of the World website; passport; visa; medical expenses and immunizations; baggage/accident/cancellation insurance; personal expenses, such as laundry; and any other items not specifically noted in the section above as included.

Payments, Cancellations, and Refunds: To make a lodge reservation, a non-refundable USD$100 deposit per booking is required. Final payment is due no later than 75 days prior to the arrival date. Payments must be made by credit card. A Guest’s reservation may be canceled if full payment has not been received by 75 days prior to arrival. For reservations made within 75 days of the arrival date, full payment is required when the reservation is accepted. All cancellation notices must be received in writing electronically or by mail and will become effective as of the date received. If a Guest cancels 61 days or more prior to arrival, an administrative fee of $100 will be charged (the non-refundable deposit). Per-booking charges for cancellations that occur less than 61 days prior to arrival (“Cancellation Penalty Period”) are as follows: 31-60 days prior to arrival: 50% of the total booking amount; 0-30 days prior to arrival: 100% of the total booking amount. Any revisions made within the Cancellation Penalty Period, such as a change in arrival date or choice of lodge, are subject to this cancellation policy. Any airline tickets issued are subject to the carrier’s refund policy. Arriving late or leaving a lodge early, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the lodge reservation. For certain lodges, additional payment and cancellation terms may apply.

Travel Warnings: If there is a US. State Department Travel Warning currently in effect for the country where a Lodge is located, that information is posted on the Lodge webpage, and Guests are responsible for reading the Travel Warning.

Documentation: Guests are responsible for obtaining any documents required for getting to and staying at the lodge such as a valid passport, all visas, vaccination certificates, and any other documents.  Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the Guest’s responsibility.

Health Requirements: National Geographic encourages Guests to consult a doctor for specific medical advice about any activities or destinations.

Medical Authorization and Coverage: Each Guest certifies that her or she has medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Guest, or that in the absence of this medical insurance coverage, the Guest agrees to pay all costs of rescue and/or medical services as may be incurred on the Guest’s behalf.  

Dispute Resolution: If the Guest has a complaint, he or she should first inform the lodge staff during the stay so that the lodge can rectify the matter. 

All disputes, claims or controversies arising out of or relating to this Agreement, brochures, or any other literature concerning National Geographic Unique Lodges of the World including the breach, termination, enforcement, interpretation or validity thereof (“Disputes”), and the scope or applicability of this Agreement to Arbitrate, including but not limited to the arbitrability of any and all Disputes, shall be determined by binding arbitration in New York County, New York before a single, neutral arbitrator who is a former or retired judge of any New York state or federal court with at least three (3) years’ experience adjudicating or handling travel industry matters.  Each party to the applicable Dispute shall share equally the costs of arbitration, but each party shall bear its own attorneys’ fees and related costs, unless otherwise provided by law or statute.  The arbitration shall be initiated and administered by JAMS according to its Comprehensive Arbitration Rules & Procedures, including Rules 16.1 and 16.2, as they exist on the effective date of this Agreement (the “JAMS Rules”).  In conducting the arbitration and in making any award, the arbitrator shall follow New York substantive law (without regard to choice of law or conflict of law rules) and New York arbitration procedure, except as otherwise provided for in the JAMS Rules or in this Agreement to Arbitrate, or where New York arbitration procedure conflicts with the Federal Arbitration Act (“FAA”), in which case the FAA shall apply.  In conducting the arbitration and in making any Award, the arbitrator shall follow the Federal Rules of Evidence.   Except as provided for in this Agreement to Arbitrate, the arbitrator shall have the authority to award any remedy or relief that a state or federal court of New York could order or grant, and no other remedy or relief.  The arbitrator has no authority to award punitive, exemplary, multiplied or consequential damages, and such damages shall not be recoverable by any other process or in any other proceeding.  Judgment on any Award may be entered in any court of appropriate jurisdiction.  This agreement to arbitrate (i) shall not preclude the parties from seeking provisional remedies in aid of arbitration not otherwise prohibited by this Agreement from a court of appropriate jurisdiction, and (ii) does not waive or modify any liability release agreed by the participant.
